These Terms & Conditions (“Terms”) govern your use of arqjewels.com (the “Site”) and any purchase you make from us. By accessing the Site or placing an order, you accept these Terms in full. If you do not agree with any part of them, please do not use the Site.

1. About us

The Site is owned and operated by ARQJewels (the “Company”), a business registered in India. Registered address: ARQJewels, India. GSTIN: [GSTIN pending].

2. Eligibility

You must be at least 18 years of age (or have your parent or guardian’s consent) and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Site. By placing an order you confirm that the information you provide is true, accurate and complete.

3. Account responsibilities

• You are responsible for keeping your account credentials confidential.
• You must notify us immediately of any unauthorised use of your account.
• You are responsible for all activity under your account that is not the result of a security failure on our part.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe are involved in fraud or abuse.

4. Products, pricing & availability

We make every effort to display product photographs and descriptions accurately. Colours may vary slightly between screens. Slight variations in handcrafted pieces are part of their character, not defects.

All prices are in Indian Rupees and inclusive of applicable GST unless stated otherwise. We reserve the right to change prices and product availability at any time. If a product is mispriced due to a technical error, we may cancel the order and refund any payment made.

5. Order acceptance

When you submit an order, you are making an offer to buy. The contract is formed only when we send an order-confirmation email. We reserve the right to refuse or cancel any order — including after confirmation — if (a) the item is out of stock, (b) we suspect fraud, (c) there is a pricing or description error, or (d) the delivery address is unserviceable. In such cases, any amount paid is refunded in full.

6. Payment

We accept online payments through Razorpay (UPI, cards, net banking, wallets) and offer Cash on Delivery on serviceable pincodes for orders within applicable limits. COD orders may require OTP verification on the registered mobile number.

7. Shipping, returns & refunds

Our Shipping Policy, Return Policy and Refund & Cancellation Policy form an integral part of these Terms.

8. Intellectual property

All content on the Site — including but not limited to the ARQJewels word mark, logos, designs, photographs, product names, copy, illustrations and code — is owned by us or our licensors and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not copy, reproduce, scrape, republish or use the content for any commercial purpose without our prior written consent.

9. User-generated content

When you post a review, comment or photograph through the Site, you grant ARQJewels a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our products and marketing. You confirm the content is yours and does not infringe any third party’s rights.

10. Acceptable use

You must not use the Site to (a) violate any law, (b) attempt to gain unauthorised access to any account or system, (c) introduce malicious code, (d) submit fraudulent payment information, or (e) scrape or systematically download our content.

11. Disclaimers

The Site and our products are provided on an “as is” basis. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement, except those that cannot be excluded under the Consumer Protection Act, 2019.

12. Limitation of liability

Our total aggregate liability arising out of or in connection with any order is limited to the amount you actually paid for that order. We are not liable for any indirect, consequential or special damages, including lost profits, lost data, or injury to feelings, except where such limitation is not permitted by applicable law.

13. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, pandemics, government action, courier strikes or internet outages.

14. Governing law & jurisdiction

These Terms are governed by and construed in accordance with the laws of India. The courts at Mumbai shall have exclusive jurisdiction over any dispute, subject to any consumer-court forum available to you under the Consumer Protection Act, 2019.

15. Changes to these Terms

We may update these Terms periodically. The “Last updated” date at the top of the page reflects the latest version. Continuing to use the Site after a change constitutes acceptance of the revised Terms.
